​Travel Terms and Conditions

1. Article 1 Purpose
The purpose of these terms and conditions is to set out the details of the overseas travel contract between Noktour's travel business division (hereinafter referred to as "the Company") and the customer (hereinafter referred to as the "customer") who has entered into a travel contract.

2. Article 2 Obligations of the Company and Customers
① In order to provide safe and satisfactory travel services to customers, the company must faithfully perform its duties in the process of establishing and executing travel plans, such as travel arrangements, guidance, transportation, and accommodation.
② Customers must actively cooperate with other travelers to promote harmony with other travelers and to maintain the travel order of travel agencies for safe and enjoyable travel.

3. Article 3 Types and Definitions of Travel
The types and definitions of travel are as follows:

1. Planned travel: A travel conducted by the Company by recruiting travelers through advertisements or other methods by setting the travel destination and tour schedule, the contents of transportation and lodging services to be provided to travelers (hereinafter referred to as 'travel service'), and travel rates.


2. Desired travel: A travel conducted by the Company after establishing an overall travel plan, such as transportation, accommodation, and tourism, according to the travel conditions desired by the traveler (individual or group).

 

3. Overseas travel procedure agency (hereinafter referred to as procedure agency contract): The company agrees to receive a prescribed procedure fee from the traveler, and performs the following tasks (hereinafter referred to as the procedure agency service) according to the consignment of the traveler. thing.
1) Procedures for obtaining visas, re-entry permits and various certificates
2) Preparation of immigration procedures and other related tasks

4. Article 4 Composition of the contract
① The travel contract includes the travel terms and conditions (contract). The itinerary (or travel manual) is the contract content.
② In the travel itinerary (or travel manual), the travel destination and contents of the tour by date of travel. Transportation. number of shopping. Accommodation place. It includes travel schedules such as meals, information on services provided by travel agencies, and notes for travelers.

5. Article 5 Conclusion of travel contract
A travel contract is deemed to have been established when a traveler applies for travel by means of the Internet, etc., and after confirming the application in accordance with the prescribed procedure, the traveler pays all or a certain amount of the travel fee to us when the traveler concludes the contract in accordance with the terms and conditions. considered. 6. Article 6 Provision of safety information and issuance of contracts, etc.
When entering into a travel contract with a customer, the company must provide the travel conditions and travel safety information posted on the Ministry of Foreign Affairs’ overseas safe travel website (www.0404.go.kr). travel manual) is issued to each traveler.

7. Article 7 Special Agreement
The company and the customer can enter into a special contract in writing (including electronic documents) within the scope of not violating related laws. In this case, the customer's consent is obtained by electronic means, etc., to be different from the standard terms and conditions.

8. Article 8 Issuance of contract and terms and conditions
When the Company concludes a travel contract with a traveler, the contract, travel terms and conditions, and travel itinerary (or travel manual) must be delivered to each traveler in one copy.

9. Provision and consideration of Article 9 Terms and Conditions
In the following cases, the company and the customer are deemed to have issued the travel terms and conditions (contract) and travel itinerary (or travel manual).

1. When the customer agrees to and applies for the contents of the travel terms and conditions (contract) and travel itinerary (or travel manual) provided through the electronic information network such as the Internet, the Company uses the electronic information network, mechanical device, phone, etc. When notified

In response to the customer agreeing to the contents of the travel agreement (contract) and travel itinerary (or travel manual) provided by the company using a mechanical device such as facsimile, and sending a document requesting the conclusion of the travel contract, the Company sends the electronic information network In the case of notifying the traveler of his/her intention to accept by using a mechanical device, etc.

10. Article 10 Cancellation of contract if minimum number of participants is not met
① If the company cancels the travel contract because the minimum number of participants is not met, the company must notify the traveler at least 7 days prior to the departure date.
② If the Company cancels the contract without notifying within the deadline in the preceding paragraph due to the insufficient number of travel participants, it must compensate the traveler for the amount determined by the Consumer Dispute Resolution Standards in addition to the refund of the down payment already paid.

11. Article 11 Refusal to conclude a contract
The Company may refuse to conclude a contract with a traveler if the traveler has any of the following reasons.
1. When it is recognized that it is a nuisance to other travelers or interferes with the smooth conduct of travel
2. When it is recognized that travel is difficult due to illness or other reasons
3. When the maximum number of events specified in the contract is exceeded

12. Article 12 Travel Fee
① Travel expenses include some or all of the following. However, in the following Nos. 1 to 9, the traveler must pay the amount directly at the travel destination, or the company entrusts it for the convenience of the traveler and pays it instead.


1. Fares of the transportation agencies used, such as aircraft, ships, and railroads specified in the travel itinerary
2. Pick-up bus fare according to the itinerary (airport, station, pier and hotel)
3. Accommodation fee according to the travel itinerary (based on double occupancy)
4. Meal fee specified in the itinerary
5. Tour guide expenses
6. Various taxes and baggage charges required during the itinerary
7. Carriage charges for the entire itinerary of baggage (according to the relevant carrier's contract of carriage)
8. Other miscellaneous expenses (items that may be included in travel expenses, such as group communication charges)
9. Other travel agency fees
② Travel expenses do not include the following:


1. Miscellaneous expenses of personal nature during the trip (communication charges, customs duties, any tips, laundry, personally added food and beverages)
2. Any expenses to be paid according to the diagnosis of a doctor due to illness, injury, or other reasons of the traveler or individual during the trip
3. Expenses incurred in excess of specifications or regulations (additional charges for one person per room, extra-standard baggage transportation costs, etc.)
4. Expenses not specifically stated in the itinerary
③ The traveler must pay the travel fee in Paragraph 1 by card, account transfer, or direct deposit in accordance with the agreement between the parties.
④ If travel insurance premiums are included (additional) in the desired travel rate, the travel agency must explain the name of the insurance company and the contents of compensation to the traveler.

13. Article 13 Change of Travel Fee
① In the case of overseas travel, if the fee to be paid to the transportation and lodging institution increases or decreases by 5% or more from the time of signing the contract, or if the foreign currency exchange rate applied to the travel fee increases or decreases by 2% or more from the time of conclusion of the contract, the company or the traveler You can claim the other party to increase or decrease the travel fee within the specified amount.
② The travel agency must notify the traveler 15 days prior to the departure date when the travel fee is increased in accordance with the provisions of Paragraph 1.

14. Article 14 Change requirements for travel conditions and settlement of fees, etc.
① The travel conditions in Article 13 above may be changed only in the case of one of the following subparagraphs.
1. When both parties agree that it is unavoidable due to the traveler's request or local circumstances for the safety and protection of the traveler
2. In case the purpose of travel cannot be achieved due to natural disasters, war, government orders, strikes, closures of transportation, accommodation, etc.
② In the event that there is an increase or decrease in the travel fee under Article 12 (1) due to the change in the travel conditions under Paragraph 1 and the change in the travel fee under Article 13, the change before the start of the trip is before the start of the trip, and the change during the trip is 10 days after the end of the trip You must settle (refund) each within.
③ In the event that the travel conditions are changed or the amount of compensation is incurred due to the cancellation or termination of the contract other than in accordance with the provisions of Paragraph 1, the amount incurred before the start of the trip shall be settled before the start of the trip, and the portion incurred during the trip shall be settled within 10 days after the end of the trip. ④ If the traveler does not receive services included in the travel fee, such as accommodation, meals, and tourism, due to his/her own circumstances after departure, the traveler cannot claim a refund of the corresponding fee. However, if the trip is terminated midway, it will be processed in accordance with Article 17.

15. Article 15 Compensation for Damages
① If the company inflicts damage to the traveler intentionally or negligently by the local travel agent, etc., the company must compensate the traveler for the damage.
② In the event that a traveler’s travel schedule is disrupted due to a traveler’s failure to obtain entrusted issuance of visas, re-entry permits, or various certificates necessary for overseas travel due to reasons attributable to the Company, the Company shall include all of the amount received from the traveler and 100% of the amount must be compensated to the traveler.
③ The Company shall not compensate for damages suffered by travelers due to delays in arrivals or delays in transportation facilities such as aircraft, trains, and ships, or due to traffic congestion.
④ The Company shall not compensate for damages in relation to the receipt, delivery, storage, loss, damage, etc. of the traveler's baggage. However, in the case of reasons attributable to the company, we will compensate the traveler for damage.

16. Article 16 Cancellation of contract before departure
① The company or the traveler may cancel this travel contract before departure. In this case, the amount of damage incurred will be compensated in accordance with the 'Consumer Dispute Resolution Standards (Announced by the Fair Trade Commission)'.
However, if the planned tour cannot be carried out because the minimum number of participants is not met, the company will compensate the traveler in accordance with the provisions of Article 10 (Cancellation of the contract if the minimum number of participants is not met).
② The Company or the traveler may cancel this travel contract without paying the amount of compensation for damages in Paragraph 1 to the other party in the event of any of the following reasons before departure.

1. When we can cancel

③ Overseas Travel Consumer Dispute Resolution Standards (Announced by the Fair Trade Commission) Cancellation Rules

1. From 30 days prior to the start of travel: Cancellation of contract without penalty
2. When notified by 29 to 20 days prior to the start of the tour: 10% of the travel expenses will be compensated
3. When notified 19 to 10 days before the start of travel: 15% of travel expenses
4. When notified 9 to 8 days before the start of travel: 20% of travel expenses
5. 7 to 1 day prior notice: 30% of travel expenses
6. When notified on the day of departure: 50% of travel expenses

17. Article 17 Termination of contract after departure
① The company or the traveler may cancel this travel contract for unavoidable reasons after departure. However, you must compensate the other party for any damage caused by this.
② If the contract is terminated pursuant to the provisions of Paragraph 1, the Company shall cooperate with the matters necessary for the traveler to return to his/her country, and the traveler shall bear the expenses necessary for this, not due to the reasons attributable to the company.

18. Article 18 Traveler's Responsibilities
① The traveler is responsible for confirming each item of Article 12 Paragraph 1 through phone call, fax, e-mail, etc. from the person in charge of the relevant travel product or his/her delegation within 7 days of departure for the smooth progress of the trip.
② The traveler is responsible for any issues related to nationality or visa-related issues that the traveler has not notified prior to the conclusion of the travel contract.
③ Travelers must faithfully cooperate with the Korean departure guide and local tour guide for the smooth progress of the trip.
④ The traveler is responsible for compensation and compensation to the company for any damage caused to the company due to the traveler's intention or negligence.
⑤ Travelers must keep their valuables and belongings at their own risk. However, in this case, the Company is excluded from the act of compensation and corresponds to the relationship between the traveler and the insurance company.
⑥ The traveler is responsible for any problems that occur due to a physical disability or disease that the traveler did not notify before signing the travel contract. However, in this case, the Company is excluded from the act of compensation and corresponds to the relationship between the traveler and the insurance company.
⑦ It is the responsibility of the traveler to check the baggage checked with the airline before moving on to the airline. If any damage to your baggage occurs after you receive your baggage for international flights, you must immediately file an objection with the carrier. However, in this case, the Company is excluded from the act of compensation and corresponds to the relationship between the traveler and the carrier.

19. Article 19 Start and End of Travel
The start of the trip starts from the point of departure and ends as soon as the itinerary ends and arrives at the final destination. However, exceptions are made when the contract and schedule are changed.

20. Article 20 Duty of Explanation
The company must explain the important contents and changes stipulated in the contract so that the traveler can understand it.

21. Article 21 Insurance Subscription, etc.
In the event of damage to customers in connection with travel, the Company purchases insurance or deductions stipulated in the relevant laws and regulations to pay insurance money or deposits a business deposit.

22. Article 22 Other matters
① In the event of a dispute over matters not specified in this contract or the interpretation of this contract, the company and the customer agree to make a decision.
② If there is a justifiable reason for traveling to a special area, it may be determined differently from the contents of the terms and conditions.
